The Weinstein case will be remembered (and probably in history) as the event that allowed the liberation of women's voices on sexual violence. But while the trial of the former producer rages, his lawyers are scrambling for an acquittal to be pronounced…

An "unpopular decision"

As a reminder, Harvey Weinstein has been accused by more than 80 women (yes yes… 80) harassment, touching or even rape. However, his judgment concerns "only" two assaults that allegedly took place in New York in 2006 and 2013.

"The media is zealous, the prosecution is zealous (…) You are called to make an unpopular decision."

Donna Rotunno – Harvey Weinstein's lawyer

Lawyer Donna Rotunno called for "ignoring the media turmoil" that characterizes this case. It should be noted that this renowned lawyer has so far obtained an acquittal for most of her clients accused of sexual assault. It's a promise.

A blur around consent?

Despite the many accusations against the 67-year-old producer, this trial focuses on two of them. And when it comes to these specific cases, it would seem that the notion of consent is blurred.

Indeed, the two alleged victims have admitted to having at least one consensual sexual relationship with Harvey after the assaults of which they accuse him. As such, several emails were unveiled, indicating that the actresses had remained on "good terms" with the accused.

Lawyer Donna Rotunno did not hesitate to use this loophole to demand acquittal for her client. "The truth leaves traces," she said, before reminding jury members that they could only convict Harvey if they were certain of his guilt "beyond reasonable doubts." These members of the jury will have to deliberate unanimously. In case of disagreements, the trial would be cancelled and another could be brought by the prosecution.

In the event that Harvey Weinstein is acquitted, he would still have to answer two other charges for sexual assault in Los Angeles. The closing arguments of prosecutor Joan Illuzzi-Orbon will take place this Friday, before a deliberation the following Tuesday. Case to follow very closely!
